Learned senior advocate appearing on behalf of the petitioner argues that there is a gulf of difference between the FIR and the statement of the victim before the learned Judicial Magistrate under Section 164 of the Cr.P.C.

The incident complained of carries with it in respect of work to be done under the supervision of the present petitioner. There are other issues which may not be very pertinent at this stage to consider taking into consideration the circumstances that the case has been committed to the court of sessions and has been

transferred to the trial court.

In view of the stage of the case, I direct the learned court in seisin of the case to take steps to overcome the stage of consideration of charges within a week from the next date so fixed. Learned trial court is directed that the victim be examined as P.W.1 within a month from the charges being framed. Petitioner is granted liberty to approach this Court after the cross-examination of the victim is over. If there are deficiencies in supply of copies, the learned trial court would complete the same and ensure that the same is completed on the next date so fixed.

At this stage, CRM(M) 2552 of 2025 is dismissed. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
