In the matter of : Bappa Gayen.
... Petitioner.
Mr. Saswata Gopal Mukherjee.
...for the Petitioner.
Ms. Faria Hossain, Ms. M. Jana.
...for the State.
Mr. Rabi Sankar Chattopadhyay, Ms. Trisha Rakshit, Ms. A. Datta.
...for the de-facto complainant.
1.
Petitioner is in custody for about eight years. He contends there is delay in trial. He prays for bail. 2.
Learned Advocate for State opposes the bail prayer. 3.
Learned Advocate for de-facto complainant also opposes the bail prayer.
4.
We have considered the materials on record. There are ample evidence connecting the petitioner with the crime. Trial has substantially progressed and most of the prosecution witnesses have already been examined. 5.
Under such circumstances, we are not inclined to grant bail to the petitioner.
6.
Accordingly, the prayer for bail of the petitioner is rejected.
7.
We request the Trial Court to conduct the trial with expedition and conclude the same at an early date
preferably within six months from the next date fixed for recording evidence without granting unnecessary adjournment to either of the parties.
