Sundar ... for the Petitioner(s) Ms. Amia Gaur Mr. Subham Bhagat ... for the State-respondent(s) Mr. Prabir Adhya Ms. Madhumanti Chakraborty ... for the Defacto-complainant Learned advocate for the petitioner submits that the petitioner was arrested on 28th September, 2025 and since then he is in custody in connection with the instant case. It has further been contended that the petitioner has been victimized as he was imposing strict rules in respect of the work to be executed by the employees of the hospital. Additionally, it has been submitted that the investigating agency has already completed investigation and the records of the case reflect that the victim lady has refused medical examination.

Learned advocate for the State opposes the prayer for bail and draws the attention of the court to the Statement of the victim under Section 164 of the Cr.P.C. Learned advocate for the defacto-complainant is present and submits that there are other criminal cases against the present petitioner and the petitioner being an influential person has been able to drag the case since the year 2008.

Be that as it may, so far as the present case is concerned, on an appreciation of the materials available, I am of the view that further custodial detention of the present petitioner so far as the present case is concerned is unwarranted.

Hence, the prayer for bail of the petitioner is Allowed.

Accordingly, the petitioner viz, Jahir Abbas Khan shall be released on bail upon furnishing bond of Rs.20,000/-(Rupees Twenty Thousand only), with two sureties of Rs.10,000/- (Rupees Ten Thousand only) each, one of whom must be local, to the satisfaction of the CJM, Tamluk, Purba Medinipur.

If on bail, the petitioner shall not enter the jurisdiction of the Sub-Division of Tamluk except for the limited purpose of attending the court and the police station. The petitioner shall make himself present before the

Panskura Police Station once in a week and obtain an acknowledgement from the Inspector-in-charge of the Panskura Police Station or any other police officer delegated by him. The petitioner shall also make himself physically available on each and every date so fixed by the learned trial court and shall not leave the district of Purba Medinipur without prior intimation to the learned trial court. Accordingly, CRM(M) 2554 of 2025 is allowed.
