Learned advocate appearing for the petitioner submits that unnecessarily the petitioner is languishing in jail for more than 3 years 3 months and till date the prosecution in spite of earlier commitment before this Court is proceeding with the examination of the witnesses.

Mr. Sengupta, learned advocate appearing for the State, on the other hand, submits that the prosecution intends to examine two or three more witnesses including the investigating officer of the case.

Having considered that the trial of the case is at the fag end, I am of the view that no interference is called for from this Court.

Accordingly, CRM(M)2555 of 2025 is dismissed.

The learned trial court would fix schedule in such manner that within a reasonable period of time, preferably by 31st March, 2026 a finality is arrived at in respect of the present case. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
