The petitioner retired from service on June 30, 2024. Prior to his retirement he was directed to refund a sum of Rs.1,82,080/- on account of overdrawn amount received by the petitioner. Pension payment order was issued in her favour on June 25, 2024. 3.

On November 27, 2025 the petitioner has filed the instant writ petition praying for refund of the overdrawn amount that was deposited.

It appears that the employee had nearly three years of service period left prior to his retirement when the anomaly in her payment was detected and the employee was directed to refund the amount overdrawn by him. The employee, without any objection, accepted and acted in accordance with such direction. The over drawn amount had duly been refunded. PPO was issued and the pension amount has also been paid.

The Court is not inclined to pass any order in favour of the petitioner for refund of the overdrawn amount. The employer has every right to rectify any error in calculation of pay in accordance with law. The employer has done so.

The writ petition fails and is hereby dismissed. 7.

Parties to act on the basis of the server copy of this order duly downloaded from the official website of this Court.
