The writ petition is dismissed as 'not pressed'. Dismissal of the writ petition will, however, not stand in the way of the KMC to take steps for removal the encroachment in the footpath in front of the premises no. 83, Jodhpur Park.

Instruction forwarded by the engineers of the KMC be retained with the records.
