(M) 2556 of 2025 In Re: An application for bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 filed in connection with Chhatna Police Station Case No.02 of 2025 dated 08.01.2025 under Sections 316(2)/318(4)/338/336(3)/61(2)/3(5) of the Bharatiya Nyaya Sanhita, 2023 and adding Sections 111(3)/111(4) of the Bharatiya Nyaya Sanhita, 2023;
Arjun Mandal
Versus
The State of West Bengal Mr. Avishek Sinha Ms. Madhusree Banerjee.
...for the petitioner.
Mr. Madhusudan Sur Mr. Amanul Islam.
...for the State.
Learned advocate appearing for the petitioner submits Bpg.
Dismissed that the petitioner is in custody for 11 months, till date charges have not been framed and one of the accused person has already granted bail. Additionally, it has been submitted that there are questionable seizures which do not connect the petitioner with the alleged offence. On any stringent conditions, the petitioner prays for bail.
Learned advocate for the State has submitted another report pursuant to the earlier directions passed which reflects the antecedents of the present petitioner.
I have considered the manner in which the offence has been committed and the subsequent addition of organized crime in course of investigation although the learned advocate for the
petitioner submits that in all those six cases petitioner has been granted bail but having regard to the petitioner being a historysheeter, I am not inclined to release the petitioner on bail. At this stage, CRM(M)2556 of 2025 is dismissed. Memo of evidence submitted by the State be kept with the record.
The investigating officer of the case is present in Court today. His further appearance before this Court is dispensed with. All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
