Mr. Indranil Halder ..for the petitioner Mr. Debanjan Mukherjee ..for CESC Limited The petitioner's application for a separate electricity connection was rejected by the Calcutta Electricity Supply Corporation (CESC) Limited on the grounds of load splitting.

Subsequently, the petitioner submitted an application to the concerned Grievance Redressal Officer by letter dated April 18, 2024, challenging the decision of CESC Limited.

Whether the separate connection as prayed for constitutes a case of load splitting requires consideration of certain factual aspects.

Accordingly, this writ petition is disposed of with the following directions:

The representation filed by the petitioner shall be considered by the concerned Grievance Redressal Officer within two months from the date of this order.

To adjudicate the dispute, the Grievance Redressal Officer shall assign a competent officer from CESC Limited to inspect the premises and verify the number of rooms in use and occupation by the petitioner. The inspection must be conducted after providing notice to the petitioner, and the petitioner shall sign the inspection report, noting any objections if any. After considering the report from the concerned officer, the Grievance Redressal Officer shall make a decision in accordance with the law.

Accordingly, WPA 27724 of 2024 is disposed of. Urgent photostat certified copy of this order, if applied for, be supplied to the learned advocates for the parties on usual undertakings.
