Guha Mr. Benazir Ahmed .... For the State Affidavit of service filed by the petitioner and the report submitted by the State are taken on record. The petitioner alleges that he entered into a construction agreement with the private respondents who are the owner, manager and staff of Jai Balaji Construction. The petitioner paid an amount of Rs.3,51,000/- by cheque and Rs.51,000/- in cash to the private respondents in terms of the agreement dated 12th April, 2025. Since then there has been no trace of the said company or the private respondents.

Pursuant to an e mail sent by the petitioner to the company, the petitioner was assured of refund of the amount within a stipulated time frame which has long expired. The petitioner lodged complaints before several police stations which have not been considered. Learned counsel for the State submits that pursuant to the complaint lodged by the petitioner before the Bhowanipore police station, specific case has been registered and investigation initiated. The petitioner explains that complaints have been lodged in other police stations as well since the private respondents have scattered themselves throughout West Bengal.

In view of the fact that investigation with regard to complaint lodged before the Bhowanipore police station has started, the investigating officer shall conduct investigation in a fair, unbiased and impartial manner and take the same to its logical conclusion in accordance with law. The investigating officer shall keep in touch with the officers of other police stations in course of investigation in order to unravel the truth and find out the whereabouts of the private respondents.

With the aforesaid observations and directions, the writ petition is disposed of.

Since no affidavit has been invited, allegations contained in the writ petition shall be deemed not to have been admitted.

Urgent certified website copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
