The State of West Bengal Mr. Arka Tilak Bhadra ...for the Petitioner In this application the petitioner has prayed for a direction upon the court below for expeditious disposal of GR Case No. 1155 of 2019 presently pending before the learned 4th Judicial Magistrate, Serampore.

Being aggrieved by the inordinate delay caused in disposal of the aforesaid proceeding, learned counsel for the petitioner submits that the FIR was lodged against ten accused persons and all the ten accused persons were charge-sheeted after completion of investigation on 30th October, 2019.

However, this High Court quashed the proceeding in connection with eight accused persons and one accused person has already died and now the entire proceeding is pending against one accused, who is the husband of the defacto-complainant.

He further submits that since 18.08.2019 the case is pending for charge hearing and the next date is fixed on 1st July, 2026. Therefore, he prayed for an appropriate direction upon the court below for expeditious disposal of the hearing.

Having heard learned counsel for the petitioner, it appears that the prayer made by the petitioner is innocuous and if it is allowed in terms of the prayer made therein, the opposite party will have no cause to prejudice and as such, the service of copy of application upon the opposite party is hereby dispensed with.

Having considered that the prayer made by the petitioner is justified, the instant application being CRR 5158 of 2025 is hereby disposed of with a direction to make charge hearing on the date fixed i.e., on 1st July, 2026 or within a period of two weeks thereafter. This order is passed invoking this court's jurisdiction under section 529 of the BNS.
