And In the matter of: Zakir Mondal @ Jakir Hossain Mondal ....Applicant/Petitioner Mr. Kaushik Choudhury ...for the petitioner Mr. Bibaswan Bhattacharya Mr. Asif Dewan ..for the State Report filed on behalf of the State is taken on record. Learned counsel appearing on behalf of the petitioner submits that other than the statement of a co-accused, there is no other material available against the present petitioner. Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail.

He relies on the statements of witnesses, the seizure list and the report. He further submits that the petitioner was one of the accused who was present at the spot but fled away. Only one accused could be arrested with the contraband. However, there are no telephonic call records or monetary trail established. Proclamation has also been issued against the present petitioner. Considering the above, the other incriminating materials available in the case diary , the fact that proclamation has been issued against the petitioner and the restriction contained in Section 37 of the NDPS Act, I do not consider this is to be a fit case for granting anticipatory bail.

Accordingly, the application for anticipatory bail of the petitioner is rejected.
