Copy of the said report has been handed over to Mr. Dasgupta, learned advocate for the petitioner.

Form the report it appears that the Board has submitted that for compliance of the order passed by the Hon'ble Division Bench in MAT 1594 of 2018, six months' time would be required.

I cannot grant such time to the Board in this matter.

When a petitioner has come before this court with prayer in his mind as appears from his representation dated 12.09.2022 (Annexure P-6 at page 65) for giving him appointment, I direct the Board to consider him as a TET qualified candidate after giving six marks as he

would be really qualifying TET 2014 as in the meantime he has secured 89 marks, if six marks are added thereto, the total marks would be 95 and the qualifying marks is 90 for the General Candidates. Therefore, the petitioner will naturally qualify the TET 2014. Now I direct the Board to take his interview and aptitude test considering him a candidate of 2022 recruitment process when the interview and the aptitude test would be videographed.

Mr. Banerjee, learned advocate for the Board, has submitted that the petitioner is over-aged. In reply, Mr. Dasgupta, learned advocate for the petitioner, submitted that may be he was not over-aged when he made the representation, being Annexure P-6, claiming appointment. The representation is dated 12.09.2022. However, I am not deciding the question of overage as it is a matter solely of the administration of the West Bengal Board of Primary Education and they will decide whether the petitioner is over-aged or not. The petitioner will file an application online for which opportunity would be granted by the Board for filing such application for 2022 recruitment process and the age would be counted on the basis of the advertisement published by the Board for 2022 recruitment process. However, if the petitioner is overaged, he shall not miss his opportunity to claim

appointment against 2016 recruitment process and 2020 recruitment process.

With the above observation and direction, this matter is disposed of.
