I find that the writ petition was filed on or about November, 2024 for the purposes of harvesting crops.

Learned advocate for the State has submitted a report, which reflects that the dispute is between the petitioner being a Bargadar and the landlord. The report also speaks that the Sub-Divisional Officer has already taken steps for terminating Barga Right of the petitioner from the suit

land.

The petitioner has already approached the Civil Court by way of a Title Suit No. 87 of 2020 before the learned Civil Judge (Junior Division), 2nd Court, Arambagh, Hooghly. The learned Civil Judge after hearing on 09.04.2024 was pleased to dismiss the said suit.

Having considered that the petitioner has already approached the Civil Court and the Civil Court has dismissed the title suit, it would be fit and proper, in the fitness of circumstances, for the petitioner if so advised, to prefer an appeal seeking necessary remedies before the learned civil court. There is no scope of this Court, at this stage, to interfere in respect of the prayers so advanced.

With the aforesaid observations, WPA 27709 of 2024 is disposed of.
