Petitioner is aggrieved by the manner of progress of Case No. 1024C/2018 which is a proceeding under Section 138 of the N. I. Act and is pending before the learned Judicial Magistrate, 2nd court, Malda. Learned advocate for the petitioner submits that the accused in a designed manner is delaying the proceedings, number of time warrant of arrest has been issued and there has been no progress in the case. Learned advocate submits further that in the month of July, 2024 date has been fixed for examination of the accused under Section 251 of the Code of Criminal Procedure. Learned Magistrate is directed to conclude the process of examination under Section 251 of the Code of Criminal Procedure on the next date so fixed or within a fortnight thereafter. Learned Magistrate after the process of Section 251 Cr.

PC is over will fix for the purposes of the present case one date in a month for progressing with the trial of the case in view of the intention expressed by the legislature for provisions of N. I. Act. All efforts be taken to conclude the trial at the earliest. No unnecessary adjournments be granted to any of the parties and in case further delayed tactics are adopted by the accused the learned Magistrate will not deter from exercising harsher process of law.

With the aforesaid observations, the revisional application being CRR

4502 of 2023 is disposed of.
