In spite of service upon the respondents no one appears on behalf of the respondents today.
The writ petition pertains to appointment in the post of Executive Assistant at Gram Panchayat Level in the District-Malda. Selection process was initiated in wherein petitioner upon offering his candidature was asked to participate in written test as well as viva-voce. According to the petitioner he performed well in both written test and viva-voce and select list was published by the respondent authorities wherefrom it appears that under the OBC-A category petitioner was selected and his name was figuring at serial no. 2 under the said category. The grievance of the petitioner is that in spite of being selected for the post of Executive Assistant he was not given appointment by giving effect to such select list which
is at page 18 of this writ petition. It is also brought to the notice of this Court that one demand justice dated 15th November, 2016 has been preferred by the petitioner whereby the grievance of the petitioner was ventilated.
On consideration of the submission made on behalf of the petitioner and perusing the select list at page-18, Annexure P-5 of the writ petition this Court directs the District Panchayat and Rural Development Officer, Malda, being the respondent no. 6 to take a decision on the claim of the writ petitioner as to why the said select list prepared on 13th November, 2016 was not given effect to after granting an opportunity of hearing to the petitioner and upon passing a reasoned order within a period of 12 weeks from the date of communication of this order. The decision to be taken by the respondent no. 6 shall be communicated to the petitioner within a period on 2 weeks thereafter. With the above direction the writ petition stands disposed of.
However, there shall be no order as to costs. Urgent photostat certified copy of the order, if applied for, be given to the parties on compliance of requisite formalities.
