Affidavit-of-service filed on behalf of the petitioner is taken on record.

Petitioner is working as Anganwadi Helper and has prayed for promotion for being engaged as Anganwadi Worker.

It is submitted that petitioner is working as Anganwadi Helper for a long period of time and she has acquired requisite qualification for being considered to be promoted as Anganwadi Worker. 4.

Union of India is represented by learned advocates. 5.

From the submission made on behalf of the petitioner, it appears that petitioner's candidature for being promoted to the post of Anganwadi Worker could not be considered previously since at the material point of time when promotional process commenced petitioner did not have the requisite qualification. Subsequently, in 2023

promotional process was initiated when petitioner could not participate.

Unless petitioner participates in promotional process by offering her candidate petitioner is not entitled to be promoted as Anganwadi Worker.

The writ petition stands disposed of granting leave to the petitioner to participate in future promotional process to be initiated by the concerned respondent authorities and it is expected in the event petitioner participates in the next promotional process her candidature will be considered in accordance with law.

There shall be no order as to costs.

Urgent photostat certified copy of this order, if applied for, be given to the learned Advocates for the parties on the usual undertakings.
