Kausik (Rejected) CRM (M) 2560 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Nayagram Police Station Case No. 01 of 2018 dated 05.01.2018 under sections 498A/302 of the Indian Penal Code, 1860;

Learned advocate appearing for the petitioner submits that the petitioner is in custody for 7 years 11 months and as such on the ground of prolonged detention learned advocate prays for bail.

On the other hand, learned advocate for the State submits that petitioner was initially granted bail on 10.04.2018 in connection with this case but since he absconded warrant of arrest was issued and he was arrested on the basis of the warrant of arrest from a different State. The date of the arrest of the petitioner subsequently is on 20.12.2023. Having considered that the petitioner was absconding for a considerable period of time and that 7 witnesses already have been examined out of the 15 witnesses to be cited by the

prosecution, I am of the opinion that at this stage it would not be fit and proper for releasing the petitioner on bail. As such CRM (M) 2560 of 2025 is dismissed at this stage.
