The writ petitioner's allegations are against the alleged illegal plying of vehicle by the respondent no.5 in violation of his permit conditions.

Allegedly, the vehicle of the respondent no.5 being WB-41-H-3306 has been plying in between Hematpur to Burdwan covering a distance of 65 kms. leaving the terminal points from the both end of the route under permit granted to him. The original route of the respondent no.5 being Benachity to Krishnanagar (express service), the same is being violated allegedly, intentionally and motivatedly by the said respondent no.5.

The writ petitioner being the operator in the route from Krishnanagar to Benachity has, thus, filed a complaint dated September 12, 2024, before the respondent no.4. Allegedly as regards the same, no

considerations have yet been made by the said respondent.

Mr. Roy, learned advocate appearing for the petitioner seeks a direction upon the said respondent to immediately consider and decide about the complaint raised by the writ petitioner vide his letter dated September 12, 2024.

Mr. Roy has handed over to the Court photocopy of the receipt copy of the complaint letter as above. Let that be taken on record.

Mr. Deb Roy, learned advocate for the State is present.

In view of the facts and circumstances, the Court finds it proper to dispose of the writ petition by directing the respondent no.4 to immediately consider and decide upon the complaint letter dated September 12, 2024, by affording adequate and reasonable opportunity of hearing to the writ petitioner and other interested persons, if any, by dint of a reasoned order. Let the respondent no.4 conclude the entire exercise as above, within a period of four weeks from the date of communication of this order.

The writ petition is disposed of.

Let the order be communicated to the petitioner within a period of one week from its date.

Urgent certified photocopy of this order, if applied for, shall be supplied to the parties, upon compliance of necessary formalities.
