Kausik (Rejected) CRM (M) 2562 of 2025 In Re: An Application for Bail under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023/ Section 439 of the Code of Criminal Procedure, 1973 in connection with Khardah Police Station Case No. 620 of 2024 dated 13.11.2024 under sections 14A(b) of the Foreigners Act, 1946 and read with section 12 of the Passports Act, 1967;

Mr. Partha Pratim Das Mrs. Rituparna Saha ......for the State.

Petitioner contends that he is an Indian citizen and to that effect have some documents in his custody and unnecessarily he has been implicated in connection with accusations under the Foreigners Act.

Learned advocate for the State submits that there are overwhelming materials against the present petitioner. In case the petitioner has documents in his custody, he would produce the same before the learned Magistrate. Learned Magistrate, if required, would consider testing the genuinity of the same by directing the Investigating Officer of the case concerned.

I do not find any fit case to be released on bail. Consequently, CRM (M) 2562 of 2025 is dismissed. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
