For the petitioner The petitioner is aggrieved by the fact of pendency of the complaint case being AC 4468 of 2019 before the ld. JM, 3rd Court at Alipore as, till date, in a proceeding under section 138 of the N.I.Act, the stage of section 251 of the cr.p.c. could not be overcome.

It has been informed that the next date is fixed on 24th of January, 2024.

Having considered the plight of the petitioner that more than four years have passed and there has been no progress in the case, I direct that on the next date so fixed or within a fortnight thereafter, the ld. trial court would conclude the stage of section 251 of the Cr.p.c. thereafter, if any application under section 143A of the N.I. Act is filed, in that case, the ld. trial court would consider the same because of the delay which has already occasioned.

Thereafter, ld. trial court will proceed with the main trial of the case by fixing at least one date in a month so that the trial of the case can be taken to its logical conclusion within a reasonable period of time. With the aforesaid observations, CRR 4607 of 2023 is disposed of.

Pending application, if any, is also disposed. Parties to act on a server copy of this order, duly collected from the official website of the Hon'ble High Court, Calcutta.
