Report of the Public Prosecutor-in-charge is placed on record.
We note due to a proposed transfer of the Judicial Officer and an anticipated vacancy in the trial court, Public Prosecutor-in-charge did not issue summons upon prosecution witnesses. Explanation is accepted. Next date for examination of witnesses is fixed on and from 21st December, 2022. We hope and trust prosecution shall examine witnesses during the forthcoming schedule.
In view of the aforesaid circumstances and the materials on record, we are not inclined to grant bail to the petitioners at this stage.
Accordingly, the prayer for bail of the petitioners is rejected.
We, however, request the trial court to conclude the trial as expeditiously as possible preferably within one year from the next date fixed for recording evidence without granting any unnecessary adjournments to either of the parties. (Ajay Kumar Gupta,J.) (Joymalya Bagchi, J.)
