The petitioner is the widow of a deceased employee of Life Insurance Corporation of India (in short, LICI), who died-in-harness on 4th September, 2023. The petitioner is claiming the terminal benefits of her husband for and on behalf of herself and her son who, according to the statement made in the writ petition, is of unsound mind.

On behalf of LICI, it is submitted that the petitioner has suppressed the material fact as a proceeding concerning the terminal benefits of the deceased employee is pending before the District Court at Hooghly being initiated by the mother of the deceased employee.

In the aforesaid facts and circumstances, the petitioner is directed to add her mother-in-law as a

party respondent to the writ petition and serve a copy of the writ petition on the added respondent. Leave is granted to the learned advocate for the petitioner to add the mother-in-law as a party respondent in the cause-title of the writ petition. Let this matter appear in the combined monthly list of September, 2024.

On the next date, LICI should come up with a break up as to the details of the terminal benefits which is available for being disbursed to the legal heiress/heirs of the deceased employee.

LICI shall also apprise the Court as to the family declaration and the nominee as per the service record of the deceased employee.

The petitioner although has made a prayer for compassionate appointment, but the petitioner is not willing to proceed with such prayer.
