Mr. Siraj Gooptu Mr. Abhirup Das ...for the petitioners Mr. Bidyut Kumar Roy Ms. Sima Biswas ..for the State Mr. Anand Keshari Ms. Soumili Choudhury Ms. Pubali Debnath Ms. Dhriti Chanda Ms.Sneha Bhattacharya ...for the de facto Learned counsel appearing on behalf of the petitioners submits that the petitioners are the husband and the mother in law. The mother in law stays separately. The husband and the wife stay together. The only allegation is that the husband is not taking care of the wife properly. The marriage took place between the couple twenty five years ago. The husband does and would do his best to take care of his wife and children.

Learned counsel appearing on behalf of the de facto complainant opposes the prayer for anticipatory bail. However, she admits that she wants to stay together with the husband. Only the husband needs to take better care of the wife and their children.

Learned counsel appearing on behalf of the State opposes the prayer for anticipatory bail.

Considering the above and the other materials available in the case diary, I do not think that custodial interrogation of the petitioners is required in this case and I am inclined to grant anticipatory bail to the petitioners.

Accordingly, the application for anticipatory bail of the petitioners is allowed.

In the event of arrest, the petitioners shall be released on bail upon furnishing a bond of Rs.10,000/- each with two sureties of like amount each, one of whom must be local, to the satisfaction of the Arresting Officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973 corresponding to Section 482(2) of the BNSS, 2023 and on further conditions that the petitioners shall not threaten or intimidate the witnesses and shall co-operate with the investigation. The petitioner no.1 shall meet the I.O. once a fortnight till submission of report in final form.

The application for anticipatory bail is, thus, disposed of. (Jay Sengupta, J.)
