1. This is an application for recalling of the order dated 05.01.2026, as passed in the intra-Court appeal being M.A.T. 2081 of 2025, whereby and whereunder the said intra-Court appeal was dismissed for default.

2. On perusal of the petition under consideration and after hearing the learned advocates for the contending parties, we are satisfied that the present appellant has shown sufficient reason for his absence on 05.01.2026 before this Court, when the instant appeal was taken up for hearing.

3. Accordingly, prayer is allowed.

4. Consequently, the order dated 05.01.2026 as passed in M.A.T. 2081 of 2025 is hereby recalled.

5. Consequently, M.A.T. 2081 of 2025 is restored to its original file and number. With the restoration of M.A.T. 2081 of 2025, I.A. No. CAN 1 of 2025 and I.A. No. CAN 2 of 2025 filed in connection with M.A.T. 2081 of 2025 are also restored to their original files and numbers.

6. Interim order, if there be any as stood vacated, is hereby restored.

7. It is submitted at the Bar that the instant appeal is otherwise, ready for hearing.

8. In view of such, let the intra-Court appeal be listed in the monthly list of May 2026 under the heading 'For Hearing'.
