His appointment may be regularized by the concerned authorities.
The grievance of the petitioner is that the case was initiated in the year 2014 and till date the examinations of the witnesses have not been commenced.
Learned advocate for the petitioner submits that prosecution in order to prove its case has relied upon 8 witnesses in the charge-sheet. As none of the witnesses has been till date examined and more than 9 years have passed since initiation of the case, I direct the learned Judicial Magistrate, 3rd Court at Sealdah to take efforts so that the examination of a particular witness may be fixed at least once in a month. In case, particular witness is not present, the Officer-in-Charge, Tangra Police Station would be directed to inform the witness concerned and submit a
report regarding the availability of the witness. Learned trial court will take a decision whether to fix a further date or close the evidence of the witnesses. No unnecessary adjournment should be granted to either of the parties and efforts be taken to conclude the examination of the prosecution witnesses by 31st December, 2024. Learned trial court thereafter shall proceed in accordance with law. With the above observation, the revisional application being CRR 4507 of 2023 is disposed of.
Pending connected application, if any, is consequently disposed of.
All concerned parties shall act on the server copy of this order duly downloaded from the official website of this court.
