Heard the learned Advocates for the parties.

We have considered the materials on record. Petitioners are not named by the witnesses before whom oral dying declaration was made by the deceased. Injured eyewitness also does not name the petitioners as members of the group who assaulted the victim. They stand on the same footing with coaccused viz., Seikh Israil @ Israil and Estab Ali who have been granted anticipatory bail.

Accordingly, we are inclined to grant anticipatory bail to them.

Accordingly, we direct that in the event of arrest, the petitioners viz., 1) Abul Aktar Siddik, 2) Md. Mojammel Hossain, 3) Md. Ibrahim, and 4) Saddam Hossain be released on bail upon furnishing a bond of Rs.10,000/- each, with two sureties of like amount each, to the satisfaction of the Arresting Signed By : ALOK SETH High Court of Calcutta 27 th of November 2024 02:53:45 PM

Officer and also subject to the conditions as laid down under Section 482(2) of the BNSS. They shall appear before the jurisdictional court and pray for regular bail within four weeks from date.
