We have considered the materials on record. Statements of witnesses before whom oral dying declaration was made implicate the petitioners in the murder. They do not stand on the same footing with co-accused viz., Seikh Israil @ Israil and Estab Ali who have been granted anticipatory bail.

In view of gravity of the offence and involvement of the petitioners therein, we are not inclined to grant anticipatory bail to them. 5.
