P.Allowed C.R.M.(A) 5196 of 2023 In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Raninagar Police Station Case No. 318 of 2023 dated 23.06.2023 under Sections 448/307/506/34 of the Indian Penal Code read with Section 9B of the Indian Explosive Substances Act.

And In Re: Anarul Sekh & Ors.

...... petitioners Mr. Mrityunjoy Chtterjee Mr. Debapriya Majumder ....for the petitioners Mr. Aniket Mitra ...for the State C.R.M. (A) 5196 of 2023 is dismissed as not pressed so far as the petitioner nos. 3, 6 and 7 are concerned as they were arrested.

Materials in the case diary do not suggest that any person suffered any injuries.

Police filed charge sheet.

Considering the nature of the incident and the complicity of the petitioner nos. 1, 2, 4 and 5 therein, we grant anticipatory bail to them.

Accordingly, we direct that in the event of arrest, the petitioner no. 1, Anarul Sekh, petitioner no. 2, Mohidul Sk. @ Islam, petitioner no. 4, Sattar Sk. @ Abdul Sattar Sk. & petitioner no. 5, Rentu Sk. shall be released on bail upon furnishing a bond of Rs.10,000/- each, with two sureties of like

amount each, to the satisfaction of the arresting officer and also be subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure, 1973. The petitioner nos. 1, 2, 4 and 5 shall appear on every date before the Jurisdictional Court on and from the date fixed for appearance of the accused and in default the jurisdictional Court will pass appropriate order to secure the presence of the petitioner nos. 1, 2, 4 & 5 in Court including cancelling the anticipatory bail granted without further reference to this Court.
