Learned advocate appearing for the petitioner submits that the petitioner has been arrested in connection with the instant case and is in custody for the last 53 days. There are hardly any materials to connect the petitioner with the crime and as such he may be released on bail.
Learned advocate for the State, on the other hand, produces the case diary including the statement of the victim under Section 164 Cr.P.C.
I find that the case was initiated under Section 140(3), BNS along with other accusations of sexual assault. Learned advocate for the defacto-complainant is present and opposes the prayer for bail. Learned advocate also submits that two accused persons are absconding.
The learned Magistrate is directed to exhaust the process of law and if required split up the trial of the case and commit the case to the Court of Sessions.
At this stage, the prayer for bail in CRM (M) 2565 of 2025 is dismissed.
Petitioner would renew his prayer for bail after the examination of the victim is over.
