Mr. Lahiri, learned Counsel appears on behalf of the appellant and submitted his full length of argument.

Mr. Agarwala, learned Counsel appearing for the State submitted that accused expired and this was recorded in the earlier order of this Court. Therefore, the appeal abates.

It appears from the record that on 14th February, 2022 this Court recorded death of the accused Tilak

Prosad Ray on 6th March, 2018. On death of the accused the appeal finally stands abated.

Accordingly, the instant appeal stands abated and disposed of.

However, the appellant may approach the Civil Court to recover any outstanding amount from the legal representative of the deceased accused in accordance with provisions of law.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court.
