Learned advocate appearing for the petitioner submits that the petitioner is in custody for 1 year 6 months and out of the proposed 12 witnesses, only seven witnesses have been examined and the prosecution is dragging the case. Other accused persons have been released on bail in connection with the instant case. As such, petitioner may be released on bail on any stringent condition.
Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that 52 kgs. of ganja was recovered from the joint possession of the petitioner and others.
Having considered the quantum of seizure and the period of detention, I am not inclined to release the petitioner
on bail. As such, the prayer for bail of the petitioner is rejected.
However, I direct the learned Trial Court to conclude the prosecution evidence by 15.02.2026, the examination under Section 313 of the Code of Criminal Procedure by 28.02.2026 and pronounce the verdict by 31.03.2026. The application for bail, being CRM (NDPS) 1585 of 2025, is, thus, disposed of.
