Learned counsel for the petitioner submits that pursuant to the prayer of the petitioner alleging extortion and torture, departmental proceeding has been initiated against the 11th respondent. The petitioner who is the key witness/victim of the incident is being served notice of hearing of the proceeding only a day prior to the date fixed for the same and is being requested to appear virtually. The petitioner is not acquainted with the virtual mode of hearing and intends to appear before the authority physically to participate in the proceeding. The petitioner seeks a direction upon the respondents to serve notice upon him well in advance so that he is able to appear before the authority in the proceeding physically for rendering his assistance.

Learned counsel for the State concedes to the submission of the petitioner and submits that henceforth notice of hearing shall be served upon the petitioner well in advance.

In view of the above, the writ petitioner is disposed of directing the concerned respondents to effect service of

notice of the departmental proceeding initiated against the 11th respondent upon the petitioner at least seven days prior to the date fixed for hearing. The petitioner is at liberty to participate in the said proceeding physically. There shall however, be no order as to costs. Since no affidavit is invited, the allegations contained in the petition are deemed not to have been admitted. Urgent certified website copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
