The petitioner alleges that the private respondents raised construction by violating the building rules.
Reliance has been placed on the communication made by the Pradhan of the Gram Panchayat which mentions the violation at the time of raising construction.
Learned advocate appearing for the private respondents submits, upon instructions that, provisional permission was obtained for raising such
construction.
The prayer for conversion of the classification of land is pending consideration at the end of the Block Land and Land Reforms Officer. As it appears from the communication made by the Pradhan of the Gram Panchayat on 4th November, 2022 that there has been some illegality at the time of raising construction by the private respondents, accordingly, the Pradhan is directed to forward a copy of the said communication to the Sub-Divisional Officer for taking consequential steps in the matter at the earliest who upon receipt of the same shall take necessary steps in the matter positively within a period of eight weeks from the date of receipt of the said communication.
Learned advocate appearing for the petitioner is directed to forward a copy of the communication dated 4th November, 2022 to the Pradhan for onward transmission to the Sub-Divisional Officer for compliance.
Be it recorded that the learned advocate appearing for the private respondents has submitted that no construction is being made at present. The writ petition stands disposed of.
Urgent certified photocopy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
