REJECTED C.R.M.(A) 5192 of 2023 In Re:- In Re:- An application for anticipatory bail under Section 438 of the Code of Criminal Procedure in connection with Chanchal Police Station Case No. 412 of 2023 dated 10.04.2023 under Section 307/323/325/326/447/34 of the Indian Penal Code and added Section 302 of the Indian Penal Code.

And In Re : Manjur Alam ...... petitioner Md. Wasim Akram ...for the petitioner Mr. Arijit Ganguly Ms. Arani Bhattacharya ...for the State Eyewitness to the incident of murder recorded as Statement under Section 164 of the Cr.P.C. where such eyewitnesses ascribe an active role to the petitioner in such murder.

Considering the gravity of the offence and the involvement of the petitioner in the incident, we are unable to grant anticipatory bail to the petitioner and the prayer for bail of the petitioner is rejected.

The application being CRM (A) 5192 of 2023 is dismissed.
