In spite of service of notice respondent no. 5 is not represented.

Matter relates to transfer of the petitioner since wife of the petitioner is suffering from ailments. An application for transfer was made on Utsashree Portal on 19th September, 2022 but grievance of the petitioner is till date aforesaid school authority has not forwarded the transfer application of the petitioner to the concerned District Inspector of Schools (SE) for processing the transfer application.

Authority of Dhamla Junior High School, DistrictHooghly being respondent no. 5 is directed to forward

transfer application of the petitioner to the concerned District Inspector of Schools (SE) by fortnight from the date of communication of this order. On receipt of transfer application concerned District Inspector of Schools (SE) shall obtain medical report from the concerned Chief Medical Officer of Health on medical verification of wife of the petitioner by fortnight thereafter and if medical report justifies transfer of the petitioner, transfer application along with medical report shall be forwarded to the concerned authority of West Bengal Central School Service Commission for taking final decision. If transfer application and medical report are received by the Chairman, West Bengal Central School Service Commission the same shall be decided by 8 (eight) weeks from the date of receipt of documents from the concerned District Inspector of Schools (SE) and decision to be communicated to the petitioner by 1 (one) week thereafter.

It is made clear that suspension of Portal shall not be a ground for rejecting transfer application of the petitioner.

Writ petition stands disposed of.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
