Matter relates to transfer of the petitioner since wife of the petitioner is suffering from ailment.
An application was made on Utshasree portal on 18th September, 2022 and same was forwarded by school authority where petitioner is presently working to the concerned District Inspector of Schools. Grievance of the petitioner is in spite of receipt of transfer
application through portal by the District Inspector of Schools (SE), Purba Medinipur, being respondent no. 4, till date no step has been taken by respondent no.4 for processing transfer application of the petitioner prior to forwarding the same to West Bengal School Service Commission. It is also submitted on behalf of the petitioner that his wife was medically verified but thereafter what was the report submitted by the concerned Chief Medical Officer of Health before the respondent no. 4, was not made known to the petitioner.
Respondents are represented by learned advocates.
Respondent no. 4 is directed to obtain medical report from the concerned Chief Medical Officer of Health, if same has not been received by him and in the event medical report justifies transfer of the petitioner, transfer application along with medical report shall be forwarded to West Bengal Central School Service Commission by three weeks from date. If Chairman of West Bengal Central School Service Commission being respondent no.3 receives document from respondent no. 4, transfer application of the petitioner shall be decided in
accordance with law by eight weeks thereafter and decision to be taken by respondent no.3 shall be communicated to the petitioner by one week thereafter.
It is made clear that suspension of Utshasree portal shall not be ground for rejecting transfer application of the petitioner. With above observations and directions, writ petition stands disposed of. There shall be, however, no order, as to costs.
Urgent photostat certified copy of this order, if applied for, be given to the parties on usual undertaking.
