Learned advocate appearing for the petitioner submits that the petitioner is in custody since 23.11.2022 and only two witnesses have been examined out of the proposed 22 witnesses cited in the charge-sheet. The cause of grievance of the petitioner is mainly the manner in which the trial is progressing before the learned Trial Court as, according to the petitioner, there is no scope of the trial concluding in near future.

Learned advocate appearing for the State, on the other hand, opposes the prayer for bail and submits that the examination of the third witness on behalf of the prosecution is in progress. Earlier, the bail application of the petitioner on merits has been rejected in the month of April, 2025. There are other vulnerable witnesses to be examined.

Prosecution is directed to conclude at least ten witnesses within the next six months.

Considering the gravity of the offence and the witnesses proposed to be examined, at this stage, I am not inclined to release the petitioner on bail as it has been pointed out that the cross-examination is being deferred at the behest of the petitioner. As such, the prayer for bail of the petitioner is rejected.

Petitioner will renew his prayer for bail after 31.05.2026.

The application for bail, being CRM (M) 2571 of 2025, is, thus, disposed of.
