1. Let affidavit-of-service, as filed in Court, be kept on record.
2.The petitioner, though aggrieved, by a notice issued under Section 13(2) of the Securitization and Reconstruction of the Financial Assets and Enforcement of Security Interest Act, 2002 (hereinafter referred to as the "SARFAESI Act"), he presently limits his reliefs to an opportunity to redeem the mortgage upon payment of the entire dues as stipulated in the notice under Section 13(2) of the SARFAESI Act, dated November 13, 2025, for a sum of Rs.13,83,098.13/-.
3.The petitioner further submits that certain payments have been made and presently a sum of Rs.13,79,317.47/- is due and payable to the Bank.
4.Petitioner is at liberty to redeem the mortgage under Section 13(8) of the SARFAESI Act, as stipulated in the notice under Section 13(2) of the SARFAESI Act.
5.Petitioner may approach the Bank, if so advised and make payment of the entire sum by December 20, 2025.
6.If the Bank agrees to receive such amount, the Bank will take steps to release the title deeds of the said property, subject to any further outstanding of the petitioner with the Bank in respect of this loan account.
7. With the aforestated directions, the writ petition is disposed of.
8. There shall, however, be no order as to costs.
9. Since no affidavit has been called for, the allegations contained in the writ petition are deemed to be denied.
10.Urgent photostat certified copy of this order, if applied for, be supplied to the parties on usual undertaking.
