For the State Mr. Anirban Das ...for the Respondent Nos. 3, 4 & 5 Petitioner has made a prayer for consideration of claim of the petitioner for appointment on compassionate ground since father of the petitioner died in harness on 7th October, 2013 who was a Group D Staff of a Government recognized aided school. Father died on 7th October, 2013 and application seeking appointment on compassionate ground was made on 22nd January, 2014.

It is submitted by the learned Advocates representing the school authority as well as State respondents that though resolution was adopted by the school authority on receipt of application from the petitioner seeking appointment on compassionate

ground but proposal for appointment on compassionate ground was not forwarded to the District Inspector of Schools (S.E.), Nadia being respondent no. 2 after adopting resolution on 8th February, 2014.

The respondent no. 2 is directed to call the Headmaster of Nabadwip Bakultala High School, Nadia and the petitioner at the time of consideration of prayer of the petitioner for appointment on compassionate ground. Such exercise is to be completed by the respondent no. 2 within a period of six weeks from the date of communication of this order and a reasoned order is to be passed on the claim of the petitioner seeking appointment on compassionate ground.

The decision to be taken by the respondent no.2 shall be communicated to the petitioner and the school authority by fortnight thereafter.

At the time of consideration of claim of the petitioner, petitioner and the Headmaster being respondent no. 5 are directed to co-operate with the respondent no. 2 by making available relevant records in order to facilitate decision making process. Accordingly, the writ petition stands disposed of.
