1. The petitioner had applied for electricity connection to operate his submersible pump, which was never given by the West Bengal State Electricity Distribution Company Limited (WBSEDCL). As such, the present writ petition has been preferred.

2. Learned counsel for the WBSEDCL, as per previous direction, files a report on inspection. The same be kept on record. It is disclosed there that certain electricity poles have to be erected for giving connection to the petitioner, which requires work to be done on adjacent plots.

3. It is submitted by the WBSEDCL that the petitioner has to procure 'no objection's from the adjacent plot holders.

4. However, it is the duty of the WBSEDCL as Distribution Licensee to give electricity connection to an applicant. It is not feasible or possible for an individual agriculturist to go about obtaining 'no objection' certificates from all nearby plot holders where electricity poles have to be erected to give connection to a particular area.

5. In any event, under the Works of Licenses Rules, 2006, it is the prerogative of the Distribution Licensee to take appropriate steps to give such connection to the petitioner.

6. Thus, the WBSEDCL shall raise quotation within a fortnight from date to the petitioner indicating the expenses required for doing the work to give connection to the petitioner.

7. Upon such quotation being raised, the petitioner shall comply with all formalities and make the payments required.

8. Upon such payment being made, the WBSEDCL shall immediately take steps for giving electricity connection to the petitioner.

9. The electricity connection shall be given to the petitioner subject to compliance of all formalities by the petitioner as expeditiously as possible, positively by January 31, 2024.

10. With the above directions, WPA No. 26500 of 2023 is disposed of.

11. There will be no order as to costs.

12. Urgent photostat certified copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities. (Sabyasachi Bhattacharyya, J.)
