15.12.2022 sdas Allowed C.R.M. (NDPS) No. 1484 of 2022 In Re:- An application for bail under Section 439 of the Code of Criminal Procedure in connection with New Town Police Station Case No. 346 of 2019 dated 28.08.2019 under Sections 21(c )/29 of the NDPS Act.

And In Re : Sarjit Khan ....... petitioner Mr. Souma Subhra Ray Mr. Aditya Bikram Mahata Mr. Sahil Kabir .....for the petitioner Mr. Saryati Datta .....for the State Learned Counsel appearing for the petitioner submits he is in custody for 1153 days. Co-accuseds have been enlarged on bail by the Hon'ble Apex Court as well as this Court. Under such circumstances and in view of the period of detention suffered by the petitioner, we are inclined to grant bail to him.

Accordingly, we direct that the petitioner shall be released on bail upon furnishing a bond of Rs.10,000/- with two sureties of like amount each, one of whom must be local, to the satisfaction of the learned Additional Sessions Judge, 6th Court, Barasat, North 24-Parganas, subject to conditions that he shall appear before the trial court on every date of hearing until further orders and shall not intimidate witnesses or tamper with evidence in any manner whatsoever.

In the event he fails to appear before the trial court without any justifiable cause, the trial court shall be at liberty to cancel his bail in accordance with law without further reference to this Court.
