Lahiri ... ... for the petitioner Mr. Ratul Biswas Mr. Kaushik Chowdhury ... ... for the WBBPE Mr. Pritam Choudhury ... ... for the DPSC, Paschim Bardhaman Learned counsel appearing for the petitioner submits that the petitioner has made an application before the Secretary, West Bengal Board of Primary Education, being the respondent No.4 in the instant application, but the said application is not considered by the Secretary till date.

Learned counsel further submits that all relevant documents regarding transfer are with the District Inspector of Schools (P.E.), being the respondent No.7 in the instant application, who has to submit the same before the District Primary School Council, Paschim Bardhaman, being the respondent No.5, who in turn will produce all necessary documents before the respondent No.4, if such application for transfer is to be considered by the respondent No.4.

Learned counsel appearing for the Board submits that if all relevant documents are produced before the

Board within four weeks from date, then the Secretary, West Bengal Board of Primary Education will consider the application of the petitioner at an earliest. Heard learned counsels for the parties.

Respondent No.7, being the District Inspector of Schools (P.E.) is requested to produce all necessary documents before the District Primary School Council, Paschim Bardhaman at an earliest. The respondent No.5, being the District Primary School Council, Paschim Bardhaman will thereafter send all necessary documents before the Secretary, West Bengal Board of Primary Education within two weeks thereafter. The Secretary, District Primary School Council, Paschim Bardhaman, being the respondent No.4 upon receipt of all the documents from the District Primary School Council, Paschim Bardhaman will consider the application for transfer of the petitioner, preferably within a period of twelve weeks from date after giving an opportunity of hearing to the petitioner.

Needless to mention that any necessary document to be produced by the petitioner may be submitted before the Secretary, West Bengal Board of Primary Education at the time of hearing. A reasoned order so passed should be communicated to the petitioner within ten days thereafter.

The writ petition being WPA 27770 of 2024 is disposed of.

There shall be no order as to costs.

Since no affidavit has been invited, the allegations contained in the writ petition are deemed to have been denied by the respondents.

Urgent photostat certified copy of the order, if applied for, be given to the parties, upon usual undertakings.
