Learned advocate appearing for the petitioner submits that the petitioner is in custody for 75 days and the vital blow was inflicted by one Bishal Routh and the present petitioner was amongst the persons against whom there are accusations that they have incited and pushed the injured victim.

Learned advocate for the State has produced the statement under Section 164 of the Cr.P.C/183 BNSS of the injured victim.

I have assessed the contentions of the learned advocate appearing for the petitioner as well as the period of detention. Having considered the same, I am of the view that further detention of the petitioner is unwarranted. As such, the prayer for bail of the petitioner is allowed.

Accordingly, the petitioner, namely, Chhotu Routh shall

be released on bail upon furnishing bond of Rs.20,000/- (Rupees Twenty Thousand only) with two sureties of Rs.10,000/- each, one of whom must be local to the satisfaction of the learned ACJM, Serampore. If on bail, the petitioner shall once in a week attend the investigating officer of the case till the same is modified by the learned ACJM, Serampore.

Accordingly, CRM(M) 2573 of 2025 is allowed.
