and within Mouza - Nandanayakbar, Khatian Nos. 915 and 899 JL No. 179 under Nandigram Police Station in the district of Purba Medinipur (as mentioned in Annexure P-2, page 42 of the writ petition). The petitioner states that a PWD road is running adjacent to the property of the petitioner and the private respondent has made a construction by illegally encroaching upon the said PWD road thereby obstructing the ingress and egress of the petitioner from his property to the PWD road. Petitioner submitted a representation dated November 12, 2025 before the Assistant Engineer, Public Works Department for removal of encroachment from the PWD road. Learned advocate appearing for the petitioner submits that in spite of receipt of such

representation no steps have been taken by the respondent authority till date.

Learned advocate appearing for the State submits that steps in accordance with law shall be taken if any encroachment is found on the PWD road. When a representation has been submitted alleging encroachment upon the PWD road, it is the duty of the respondent authority to take steps in accordance with law if there is any encroachment upon the PWD road.

In the light of the submission made by the learned advocate appearing for the respective parties this writ petition stands disposed of by directing the Assistant Engineer, Public Works Department, Haldia, being the respondent no. 3 herein, to consider the representation of the petitioner dated November 12, 2025 and after making necessary enquiries and demarcation through competent officials if any encroachment upon the PWD road is found, appropriate proceeding in accordance with Section 10 of the West Bengal Highways Act, 1964 shall be initiated and the entire exercise under the said provision shall be completed as expeditiously as possible but positively within a period of eight weeks from the date of receipt of a server copy of this order

along with a copy of the representation dated November 12, 2025.
