Heard learned advocates appearing for the parties. Petitioner has filed this writ petition being aggrieved by inaction on the part of the respondent appellate authority concerned in disposing the appeal in question filed by the petitioner on 5th May, 2015 before the CIT (Appeal) - II, Kolkata. It is unfortunate that even after more than seven and half years of passing the time of filing the appeal till date the CIT (Appeal) concerned has found no time to dispose the appeal of the assessee petitioner. It is a sheer negligence and lackadaisical attitude of the appellate concerned in performing their duties being officer of such a higher rank. This conduct of the act department is not appreciated by this Court and the Principal Chief, CIT, Kolkata shall hold an enquiry into the matter and take appropriate steps against the appellate authority concerned for whose default the appeal in

question could not be disposed of and kept pending for more than seven and half years.

The respondent appellate authority concerned is directed to dispose of the appeal in question positively within eight weeks from the date of communication of this order by passing a reasoned and speaking order after giving an opportunity of hearing to the petitioner or its authorized representatives.

Let a copy of this order be forwarded by the Registrar General of this Court to the Principal Chief, CIT, Kolkata.

With this observation and direction, this writ petition being WPA 27539 of 2022 is disposed of. (Md. Nizamuddin, J.)
