Learned advocate appearing for the petitioner submits that the petitioner is in custody for more than 6 years and there has been no progress in the trial since the Division Bench of this Court passed the order in CRM(DB) 315 of 2025 on 27.02.2025. Learned advocate appearing for the State opposes the prayer for bail and submits that till date 21 witnesses have been examined and they intend to examine five more witnesses to conclude the prosecution evidence.

Having considered the prayer restricted to Article 21 of the Constitution of India at the behest of the present petitioner, I direct the learned trial court to conclude the evidence of the prosecution including Section 313 of the Code of Criminal Procedure by 31st March, 2026. To that effect, learned trial court would, if required, conduct day-to-day trial of the present case. The

trial of the case would continue in spite of any resolution of the local bar. No unnecessary adjournments be granted to any of the parties and if without contributing to any delay the petitioner continues to be detained for reasons beyond control or for fault of the prosecution, the petitioner be released on bail after the aforesaid period is over.

With the aforesaid observations, CRM(M) 2576 of 2025 is disposed of.

Report submitted by the State be kept with the record. State is directed to communicate this order to the learned trial court through the learned public prosecutor representing the State.

All parties shall act on the server copy of this order duly downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance of all requisite formalities.
