Learned advocate appearing for the petitioner submits that the petitioner is in custody for eight months and the accusations against him relate to recovery of 298 bottles of phensedyl. Petitioner submits that there is no possibility of the trial commencing as one of the accused person is absconding. Learned advocate for the State opposes the prayer for bail as commercial quantity of contraband has been seized. Having regard to the stage of the case, I am not inclined to release the petitioner on bail.

Accordingly, the prayer for bail of the petitioner being CRM (NDPS) 1574 of 2025 is dismissed.

However, the learned trial Court will split up the trial after exhausting the process of law and at the earliest take steps for overcoming the stage of consideration of charges. Petitioner would be at liberty to approach this Court after the charges are framed by the learned trial Court. All parties shall act in terms of server copy of the order downloaded from the official website of this Court. Urgent photostat certified copy of this order, if applied for, be supplied to the parties upon compliance with all requisite formalities.
