The petitioners allege unauthorized construction at Premises No. X-12/B, S. A. Farooque Road, Ward No. 140, Borough XV, Nadial, within the jurisdiction of the Kolkata Municipal Corporation.

The learned advocate for the Kolkata Municipal Corporation has submitted a report, which indicates that the Corporation has already initiated demolition proceedings under Section 400(8) of the Kolkata Municipal Corporation Act, 1980. The report further states the unauthorised construction in question was partially demolished on December 12, 2023. The report shall be kept on record.

In light of the above, there is no necessity to keep the writ petition pending. The Corporation is at

liberty to continue the demolition of the remaining unauthorised construction in accordance with the law. Accordingly, WPA 27548 of 2022 is disposed of. Urgent certified website copies of this order, if applied for, be made available to the parties upon compliance with the requisite formalities.
