Obaidullah ..for the IIT On December 15, 2023 this Court passed the following order:- "It is the grievance of the petitioner that one Debraj Biswas has been appointed as a "Junior Assistant" under Scheduled Tribe category at the Indian Institute of Technology, Kharagpur (in short, IIT) though he does not belong to the said category.

Denying the allegations, it has been submitted by the learned advocate for the IIT that Debraj Biswas is a Scheduled Tribe candidate and he has been given appointment on due production of his caste certificate.

The University shall produce a copy of the caste certificate of Debraj Biswas on the next date of hearing." Today the scheduled tribe certificate of Mr. Debraj Biswas has been produced by the Indian Institute of Technology, Kharagpur.

A copy of the said certificate has been made over to the learned advocate appearing for the petitioner. I am not inclined to decide the validity of the caste certificate of Mr. Debraj Biswas in this writ petition in his absence. The petitioner may challenge the same before the appropriate forum in accordance with law. Accordingly, WPA 26541 of 2023 is dismissed.

Urgent photostat certified copy of this order, if applied for, be supplied to the parties expeditiously on compliance of usual legal formalities.
