For the Petitioner Mr. Pinaki Dhole Ms. Ananya Neogi ....For the State Mr. Chakraborty, learned counsel appearing on behalf of the petitioner submits that the endurance test has been held on January 24, 2023 after the order dated 16th January, 2023 passed by this Court. In the endurance test held on January 24, 2023, the petitioner was found to be disqualified. In the endurance test as he was not able to complete running with Delivery Hose (80M) within the qualifying time, i.e. within 14 seconds. The decision of the Divisional Fire Officer as handed over in Court today is retained with the records. Since the petitioner has been held to be disqualified in the physical endurance test, nothing further remains to be adjudicated in the present writ petition.

In the circumstances, W.P.A. 27558 of 2022 is dismissed.

Since no affidavits have been directed to exchanged in this writ petition, all the allegations contained in the petition are deemed not to have been admitted by the parties. All parties shall act on the server copy of this order duly downloaded from the website of this Court. Urgent photostat certified copy of this order, if applied for, be given to the parties upon compliance of all the formalities.
